Common Questions

  1. What is the purpose of the Alabama Mvt 20 1 form?

The Alabama Mvt 20 1 form is specifically designed for lienholders to record or transfer a lien on a motor vehicle that has an outstanding Alabama title. This form cannot be used for transferring ownership or by designated agents. It serves to ensure that any security interest in the vehicle is properly documented with the Alabama Department of Revenue.

  2. Who should use this form?

This form is intended for lienholders who need to record a lien against a vehicle owned by someone else. If you are an owner looking to transfer ownership, you will need a different form, specifically the MVT 5-1E. It’s crucial that only lienholders complete and submit this application.

  3. What information is required on the form?

To complete the Mvt 20 1 form, you will need to provide detailed vehicle information, including the Vehicle Identification Number (VIN), year, make, model, color, and odometer reading. Additionally, the form requires the lienholder's name and address, as well as the owner's information. Accurate details are essential to avoid delays in processing.

  4. What is the fee associated with this application?

The application requires a non-refundable processing fee of $15. This fee must be paid in certified funds made out to the Alabama Department of Revenue. Personal checks or cash are not accepted, so be sure to prepare your payment accordingly.

  5. What documents must accompany the Mvt 20 1 form?

When submitting the Mvt 20 1 form, you must include the current Alabama title for the vehicle. This is crucial for the application to be processed. Ensure that all documents are legible and complete to avoid any issues.

  6. Are there any exemptions to titling?

Yes, there are specific exemptions. For instance, vehicles older than 35 model years, certain manufactured homes, and low-speed vehicles are exempt from titling. If your vehicle falls under these categories, you cannot use the Mvt 20 1 form for titling purposes.

  7. What happens if the form is filled out incorrectly?

If the Mvt 20 1 form is filled out incorrectly or is illegible, it will be returned to you for correction. It’s important to take your time and ensure all information is accurate and clear to avoid delays in processing your application.

  8. Can I make changes to the owner information on the form?

Changes to the owner information are not permitted, except for address changes. The vehicle and owner information must match what is on the surrendered Alabama title. This consistency helps maintain accurate records.

  9. How can I obtain additional copies of the form?

You can easily obtain additional copies of the Mvt 20 1 form by duplicating it or downloading more from the Alabama Department of Revenue's website. It’s readily available for your convenience.

Documents used along the form

When dealing with vehicle titles and liens in Alabama, several forms and documents may accompany the Alabama Mvt 20 1 form. Each document serves a specific purpose and plays a crucial role in the process of recording or transferring a lien. Below is a list of commonly used forms that you might encounter.

  • MVT 5-1E: This form is used by designated agents to record liens. Unlike the Mvt 20 1 form, which is strictly for lienholders, the MVT 5-1E allows agents to facilitate the lien recording process on behalf of vehicle owners.
  • MVT 1: This is the standard application for a certificate of title. It’s typically used when a vehicle is being bought or sold, and it helps establish ownership officially with the state.
  • MVT 2: This document is a title application for vehicles that have been previously titled in another state. It’s essential for transferring titles from out-of-state vehicles into Alabama.
  • MVT 3: This form is utilized for applying for a duplicate title. If a vehicle's title is lost or damaged, this form allows the owner to request a replacement.
  • MVT 4: Known as the Affidavit of Ownership, this form is used when the owner is unable to provide a title for a vehicle, often due to circumstances like theft or loss. It helps establish rightful ownership.
  • FedEx Bill of Lading: To streamline your shipping process and ensure all legalities are met, consider using the My PDF Forms, which provides a comprehensive format for this essential document.
  • MVT 10: This is the application for a title for a homemade or custom-built vehicle. It requires additional documentation to prove the vehicle's specifications and construction.
  • MVT 5: This form is used for the transfer of ownership of a vehicle between individuals. It’s essential for ensuring that the new owner is legally recognized.
  • MVT 6: This document is used for recording a lien on a manufactured home. It’s specific to homes that are classified as vehicles under Alabama law.
  • MVT 7: This is the application for a title on a vehicle that is being registered for the first time. It’s particularly important for new vehicles that have never been titled.
  • MVT 8: This form is a request for an exemption from the title requirement. It’s used when a vehicle qualifies for exemption based on age or type, such as certain trailers or older vehicles.

Understanding these forms can simplify the process of managing vehicle titles and liens in Alabama. Each document has its specific purpose, and using them correctly can help avoid delays and ensure compliance with state regulations. Always consider consulting with a professional if you have questions about which forms you need for your particular situation.

Instructions

This form shall be typed or printed legibly.

Illegible forms will be returned.

This form is designed for use by a lienholder in order for an owner of a vehicle to comply with section 32-8-61, Code of Alabama 1975, where an owner creates a security interest in a vehicle.

This form may not be used on a transfer of ownership or by designated agents. Designated agents shall use form MVT 5-1E to record liens.

NOTE: Vehicle information and owner information shall be identical to information appearing on surrendered alabama title except for current mailing address and current alabama resident address.

SUPPORTING DOCUMENTS – This application shall be accompanied by the current Alabama title to this vehicle and the title fee (certified funds only) payable to the Alabama Department of Revenue.

Exemptions

(1)Effective January 1, 2012, no certificate of title shall be issued for any manufactured homes, trail- er, semi-trailer, travel trailer, or folding or collapsible camping trailer more than twenty (20) model years old. This exemption is applicable on January 1 of each year and applies to all manufactured homes, trailers, semi-trailers, travel trailers, and folding or collapsible camping trailers with a model year, as designated by the manufacturer, older than twenty (20) years from the current cal- endar year. All utility trailers, other than folding or collapsible camping trailers, are still exempt from titling regardless of the year model.

Example: As of January 1, 2012, all 1991 and prior year model manufactured homes, trailers, semi-trailers, travel trailers, and folding or collapsible camping trailers are exempt from the titling provisions of Chapter 8, Title 32, Code of Alabama 1975.

(2)Effective January 1, 2012, no certificate of title shall be issued for any motor vehicle more than thirty-five (35) model years old. This exemption is applicable on January 1 of each year and applies to all motor vehicles with a model year, as designated by the manufacturer, older than thir- ty-five (35) years from the current calendar year.

Example: As of January 1, 2012, all 1976 and prior year model motor vehicles are exempt from the titling provisions of Chapter 8, Title 32, Code of Alabama 1975.

(3)Effective January 1, 2012, no certificate of title shall be issued for a low speed vehicle. A low speed vehicle is defined as a four-wheeled motor vehicle with a top speed of not greater than 25 miles per hour, a gross vehicle weight rating (GVWR) of which is less than 3,000 pounds and complying with the safety standards provided in 49 C.F.R. Section 571.500. The term includes neighborhood electric vehicles.

NOTE: The exemption from titling does not invalidate any Alabama certificate of title that is currently in effect. However, no subsequent title, including a certificate of title to record or transfer a lien, can be issued if the vehicle is exempt from titling.

Common mistakes

Filling out the Alabama MVT 20 1 form can be straightforward, but several common mistakes can lead to delays or complications. One frequent error is failing to provide the correct Vehicle Identification Number (VIN). The VIN must be 17 characters long for vehicles from 1981 onward. If the VIN is incorrect or incomplete, the application may be rejected, requiring resubmission and additional time to process.

Another mistake involves inaccuracies in the owner information section. The name and address must match exactly with the details on the current Alabama title. If there are discrepancies, such as a misspelled name or an outdated address, the application will not be processed. It is essential to double-check this information to ensure it aligns with the existing title.

Additionally, many applicants overlook the requirement for certified funds when submitting the application fee. The form specifies a fee of $15, which must be paid in certified funds. Personal checks and cash are not accepted. Neglecting to follow this guideline can result in the application being returned, further delaying the process.

Finally, individuals often fail to sign the form correctly. Each owner or authorized representative must sign in ink. If the signatures are missing or not properly executed, the application will be deemed incomplete. Ensuring that all required signatures are present is crucial for the timely processing of the title application.

Similar forms

The Alabama Mvt 20 1 form serves a specific purpose in the realm of vehicle ownership and lien recording. Several other documents share similarities with this form, particularly in their function and requirements. Here’s a list of nine documents that are comparable:

  • MVT 5-1E: This form is used by designated agents to record liens on vehicles. Like the Mvt 20 1, it requires detailed vehicle and owner information but is specifically tailored for agents rather than lienholders.
  • MVT 1: This is the standard application for a certificate of title. Both forms require similar vehicle identification details and ownership information but serve different purposes—one for title application and the other for lien recording.
  • MVT 5-1: This document is utilized for the transfer of ownership. While the Mvt 20 1 focuses on lien recording, both forms necessitate accurate vehicle and owner data.
  • Florida Sales Tax Form: This essential document, known as DR-15CS, allows businesses in Florida to report and remit their sales taxes accurately, ensuring compliance with state requirements. For detailed information about obtaining this form, visit floridaformspdf.com/printable-florida-sales-tax-form.

  • MVT 10: This form is for applying for a duplicate title. Similar to the Mvt 20 1, it involves verifying ownership and may require supporting documents to confirm the vehicle's status.
